What is out-of-court representation?
Out-of-court representation is an activity in the practice of a lawyer to help protect the legitimate rights and interests of clients when performing civil activities and transactions and working with competent state agencies.
Article 29 – The Law on Lawyers 2006 stipulates: Out-of-court representation means that a lawyer represents a client to deal with matters related to the work that the lawyer has received according to the scope and content of the legal service contract or as assigned by the agency or organization where the lawyer practices as an individual working under the labor contract.
Out-of-court representation process by Lawyers
Starting Time:

When legal representation arises.

When the authorized representation is legally established by the Power of Attorney Contract.
Time of termination of representation:
-
As required by law or upon expiration.

When the job is done.
-
When a party dies, misses, loses act capacity or has limited act capacity.

When one of the parties ends the proxy representation agreement unilaterally

To request relevant agencies and organizations to provide information and documents and create favorable conditions for carrying out the authorized work.
Actively provide legal aid within the scope of authorization, receive authorized remuneration according to the agreement and be paid reasonable expenses.
About obligations

Preserve assigned documents and keep confidential information from authorized work.

Perform the delegated work in the best way and notify the delegate constantly

Compensation for damage caused by errors in the process of out-of-court representation (if any)

Return the arising property to the authorizing party.

Inform the 3rd party of the time and scope authorized.
