DOES SAME-SEX MARRIAGE BANNED IN VIETNAM? - LHLEGAL LAWYERS

A same-sex marriage is a marrige of two individuals who are of the same biological sex. Currently, same-sex marriage is legalized in a number of nations. In Vietnam, the Law on Marriage and Family 2014 does not strictly prohibit same-sex marriage. Specifically, in Article 8 of the Law on Marriage and Family 2014 as follows:

“Article 8. Conditions for marriage

….

2. The State does not recognize marriage between people of the same sex.”

It is clear from the aforementioned clauses that the law as it is does not forbid gay persons from getting married, but it does not recognize this. Legally, same-sex couples cannot live together as husband and wife after getting married because their union is not recognized by law. This means that present laws governing marriage and families, such as those governing spousal relationships, property ties, and the identification of parents and children, do not apply to same-sex marriages.

Additionally, there are currently no sanctions for same-sex marriage under the legislation.

Thus, according to the provisions of Vietnamese law, same-sex marriage is not recognized and also not sanctioned.
